Selling Vehicles With Missing or Modified Smog Equipment

Car dealerships must comply with state vehicle emissions requirements in order to remain in business. If a dealership were to knowingly sell a car with missing smog equipment, or have any modifications that are not smog-legal, they could be subject to fines and other penalties imposed by the state, including civil lawsuit claims.

Dealerships should be aware of these laws and avoid marketing a vehicle that does not meet the smog test requirements. Working with a reputable smog certified mechanic shop is critical to ensuring your vehicles are inspected properly and smogged legitimately.

If a dealer is found to be in violation of regulations, it could lead to serious criminal, legal, and financial consequences. In addition, if the vehicle is found to be defective within a certain number of miles or during a defined period of ownership, the customer could be entitled to compensation as well as reimbursement for any repairs done on the car.
