The CCPA establishes certain obligations for businesses, including maintaining reasonable security measures to protect personal information, implementing a process for handling consumer requests, and training employees on the requirements of the law. Non-compliance with the CCPA can result in significant fines and legal liability for businesses.

The California Consumer Privacy Act (CCPA) was recently updated with new rules that went into effect on March 29, 2023. The updated CCPA includes several changes that businesses must be aware of to make sure they are in compliance with the law.

One of the major changes is the expansion of the definition of personal information. The new rules now include categories such as internet or other electronic network activity, geolocation, data, and sensory information. This means that businesses must take additional steps to ensure that they are collecting, using, and disclosing this information in accordance with the law.

Another significant change is the creation of a new category of personal information known as sensitive personal information. This includes information such as SSNs, driver’s license numbers, and financial account information. Businesses must obtain explicit consent from consumers before collecting or disclosing sensitive personal information, and they must provide additional disclosures in their privacy policies.

Additionally, the updated CCPA includes new requirements for businesses that sell personal information. They must now provide a clear and conspicuous opt-out mechanism on their websites and honor opt-out requests within 15 days. The law also requires businesses to provide consumers with a “Do Not Sell My Personal Information” link on their homepage.

In summary, the updated CCPA expands the definition of personal information, creates a new category of sensitive personal information, and imposes new requirements on businesses that sell personal information. Businesses need to make sure they are in compliance with these new rules to avoid potential fines and legal liability.
